Holyshift Policy
Terms and Conditions:
General Terms:
Sessions: Sessions are available according to the schedule provided by HolyShift Fitness. The schedule may change at HolyShift’s discretion. Members must book sessions in advance using Google Sheets.
Attendance: Members are expected to attend all booked sessions. No-shows or late cancellations (within 2 hours of the session) will result in the session being deducted from the member's weekly account. Members can redeem the missed session by paying a 100 EGP fee, which must be paid before the next class.
Personal Property Damage: HolyShift Fitness is not responsible for loss or damage to personal property. Members are advised to keep valuables secure.
Property Damage: Members shall, at all times, use the items/machines in the Gym with the management instructions and within workout classes. In case of misuse of any of the said, members will compensate the Gym for the actual loss or damages, which the HolyShift Fitness management or the Market value will define.
Social media & advertising: Taking videos and pictures helps us a lot in our social media efforts and advertising campaigns. HolyShift reserves the right to use this Data.
Verbal Exceptions: No verbal exceptions from company staff are allowed without written approval from management.
Identification Requirement: Members must submit a copy of their national ID card to HolyShift management.
Membership Access: Members are allowed to attend up to 3 times per week for all types of memberships.
Enrollment Fee For Annual Membership: A one-time enrollment fee of 500 EGP applies to the Annual membership. This fee is payable upon signing the contract and is non-refundable.
1-. Cancellation and Refunds:
1.1 Missed Membership Duration: Members are not entitled to any compensation or reimbursement for periods they did not attend, as the gym management did not restrict their access.
1.2 Membership Refund Terms: Refunds are only applicable to annual memberships. All other membership types are non-refundable.
1.3 Annual Membership: To cancel, members must send written notice via email and complete the Exit Form in person at the gym 30 days prior to the exit date. A partial refund will be calculated based on the number of valid months remaining after the 30-day notice period, processed through the same payment method.
2. Membership Freeze Policy
2.1 Freeze Not Available: Freezes are only applicable to annual memberships. All other membership types are not eligible for freezes.
2.2 Annual Membership: Members are entitled to 14 days of freeze time during the 12-month membership. An additional 4 weeks can be purchased for 500 EGP when signing the contract. Freeze requests, which must be made via email or WhatsApp, are divided into phases. Each phase requires a minimum of 7 days per freeze request. If fewer than 7 days are frozen, it will still count as one phase, but only the exact number of frozen days will be added to the end of the membership.
3. Privacy and Data Protection:
3.1 Personal Information: HolyShift Fitness collects and stores personal information in accordance with privacy laws. This information will not be shared without the member’s consent.
3.2 Assessment Data: Information gathered during physical and nutrition assessments will be used to tailor fitness plans and will be kept confidential. The Recipient may disclose the Disclosing Party's Confidential information to those of its Representatives who need to know this Confidential Information to analyze/assess.
4. Membership Termination:
4.1 HolyShift Fitness rights: HolyShift Fitness reserves the right to terminate/suspend membership for violation of these terms and conditions for any for cause, such as behavior harmful to other members, the gym property, or for behavior deemed inappropriate with staff, HolyShift will have the right to terminate the membership.
4.2 Non-Payment of Fees: If the member fails to pay the agreed fees or any other charges, HolyShift will have the right to terminate the membership immediately.
4.3 Violation of Rules and Regulations: If the member violates the rules and regulations of the gym, such as proper use of equipment or dress code, the gym may have the right to terminate the membership.
4.4 Consequences of Termination: The termination clauses may outline the consequences of termination, such as the payment of any outstanding fees or the forfeiture of any prepaid fees.
5. Copies of the Contract:
This contract is made in two identical copies. By signing below, both parties acknowledge that each has received one signed copy of this contract. The member's signature serves as confirmation of receipt of their copy.
Waiver and Release:
I, the undersigned, acknowledge that I am voluntarily participating in activities at HolyShift. I understand that physical exercise can be strenuous and subject to risk of serious injury. I hereby release and hold harmless HolyShift, its employees, and agents from all liability, claims, demands, and causes of action arising from my participation in any fitness or nutrition program.
I hereby release, waive, discharge, and covenant not to use HolyShift, their owners, employees from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, physical injury that may be sustained by me, or any property belonging to me, while at HolyShift.
Amendments:
Changes to Terms: HolyShift Fitness reserves the right to amend these terms and conditions at any time. Members will be notified of any of those changes in writing in their registered email. By joining HolyShift Fitness, members agree to these terms and conditions and commit to maintaining a respectful and positive environment for all.
